One of a Kind Party Creations: Service Terms

Payment:
- A 50% non-refundable deposit is required to secure the date.
- Deposits and payments can be made online.
- For credit card payments, a 4% convenience fee will be applied.

Cancellation and Change Deadlines:
A. For purchases under $500:
- The deadline to modify or cancel an order is 8 am, Central Time, seven (7) days before delivery.
- Orders canceled or changed after this deadline will not be refunded.
B. For purchases over $500:
- Editing and making changes is possible only in the direction of increasing the number of items or slightly changing the design of the scenery. More radical changes require consent from One of a Kind Party Creations.
- The deadline to submit your request is 8 am, Central Time, thirty (30) days before the date of the event. The deposit is not refundable.
- Orders canceled or changed after this deadline will not be refunded.
- Cancellation requests must be received by email prior to the deadline and are subject to a cancellation charge of 10% of the order value.

- Consider your order canceled or changed only when you have received confirmation by email.

Additional Fees and Responsibilities:
- Permit fees, expediting fees, drawing fees, or any other expenses incurred by One of a Kind Party Creations must be paid in full regardless of the event outcome.
- Generators and air conditioning systems have hour meters; all events have a runtime charge listed on the invoice, and any overages are charged at $75.00 per hour per unit.
- Late payments from customers on pre-approved credit terms will be subject to a 3% per month late payment fee based on the invoice total. The late fee will be automatically added to the invoice and sent to the client.
- It is the client's responsibility to carry replacement cost insurance for any equipment rented from One of a Kind Party Creations.

Outdoor Decoration:
- Weather & Atmospheric Conditions: Clients understand that some decor items may be affected by temperature and humidity and that One of a Kind Party Creations cannot be held responsible for the decor in an uncontrolled climate, such as rain or extreme heat, and/or unforeseen acts of nature. In such cases, One of a Kind Party Creations has the option of making changes to the decor in the best interest of the Client. We never guarantee perfect results with balloon decor outdoors. However, we will do everything in our power to ensure the decor holds up by using the best quality balloons.
- In the event that weather or another unforeseen act of nature prevents One of a Kind Party Creations from decorating the Client’s event, the decoration booking fee can be applied to another day/event within 12 calendar months from the original date of the event, subject to availability. No refunds will be given.
- One of a Kind Party Creations is not liable for actions by others or weather conditions beyond our control. We retain the right to abort the project at any time if continuing may damage the reputation of the Client and/or One of a Kind Party Creations and/or cause a safety hazard.
- All outdoor performances must be conducted in a safe manner, and there must be an indoor rain contingency plan. If cancellation occurs without such a contingency, the Client agrees to compensate One of a Kind Party Creations with the full booking fee.
